DMCA / Takedown Policy

Hoca operates the following process to remove third-party copyrighted material processed without permission, or material that violates personal rights, from the platform.

Filing a complaint

There are two ways to file an infringement claim:

1. Web form: /legal/takedown — fast and trackable.
2. Email: dmca@hoca.example.com — preferred for attaching documents.

Required information

A valid takedown request must include:

1. Claimant identity — name, organization, email, phone
2. Allegedly infringed work — title, ISBN/ISSN/registration number, rights holder
3. Location on Hoca — job_id, downloadable URL, or user email
4. Statement of ownership — "I declare that I am the rights holder of this material, or the authorized representative of the rights holder"
5. False statement liability — "I acknowledge legal responsibility for knowingly making misleading statements"
6. Electronic signature (name + date)

Process

1. Receipt confirmation: automated email within 24 hours.
2. Content suspension: on receiving a valid request, the relevant job is flagged with is_taken_down=1, downloads are blocked, and the user is notified.
3. Right to counter-notice: the user may submit a "this content is mine, not unauthorized" counter-document within 14 days.
4. Final decision: if a counter-notice is filed, a lawyer reviews; otherwise the content is permanently deleted.
5. Repeat infringement: 3 confirmed complaints from the same user → account closure.

Protection against false / abusive claims

• Frivolous takedown requests constitute a criminal offense (legal sanctions).
• Repeated requests from the same IP within minutes are rate-limited (/legal/takedown 5/minute).
• All requests are recorded in AuditLog with legal.takedown action; tracked from the admin panel.

Voice clone special provisions

A person who notices their voice being used in Hoca without consent may:

• Submit a request via the same form (target_type=voice, target_id=<voice_id or guessed email>).
• The admin precautionarily flags the voice sample with disabled=True without verification first (precautionary takedown, legally safe).
• The user may submit "this is my voice" evidence within 14 days (e.g. content registered on another platform).
